The Election Petition Tribunal sitting in Ibadan has again rendered the petition of the Accord Party Senatorial Candidate, Hon Shina Peller, against the All Progressives Congress (APC) candidate, Senator Buhari AbdulFatai representing Oyo North Senatorial District, useless for lacking merit.

The judgments of the Election Petition Tribunal sitting at Court 3, High Court of Justice, Iyanganku Ibadan, on Friday 25th August, 2023,in a petition brought to her by the Accord Party Senatorial Candidate, Hon Shina Peller against the APC candidate, Senator Buhari AbdulFatai, have been dismissed for lacking merit and not being able to prove that over voting took place in the 2023 Oyo North Senatorial District election.

The Accord Party petition against Senator Buhari AbdulFatai was struck out on the following grounds.

1. Over voting : Over voting could not proved . So election cannot be overturned

2. Non compliance : Accord Part’s Hon Shina Peller failed to prove non compliance

3. The number of votes in the affected areas is infinitesimal to affect the final results because the total number of votes of the petitioner (Shina Peller) is 7000 , and the margin between him and the first and second respondent is 34,000

So the petition was dismissed for lacking in merit and all the three (3 ) judges agreed on the lead judgment.
