Senator Buhari Floors NNPP In Court
..petition rendered incompetent, invalid, null and void as petitioner failed to prove his case.
The Election Petition Tribunal sitting in Ibadan has rendered the petition of the New Nigeria People’s Party (NNPP) Senatorial Candidate, Mr Shuaib Adeniyi, against the All Progressives Congress (APC) candidate, Senator Buhari AbdulFatai representing Oyo North Senatorial District, incompetent, invalid, null and void as the petitioner failed to prove his case.
On Thursday 24th August, 2024, the judgments of EPT sitting at Court 3, High Court of Justice, Iyanganku Ibadan, in a petition brought her, as being read by Justice N.J Dadi, dismissed the petition of the NNPP Senatorial Candidate, Mr Shuaib Adeniyi against APC, Senator Buhari AbdulFatai, as lacking merit, invalid and void.
The case was struck out on the following grounds.
1. Petition is rendered incompetent, invalid, null and void as petitioner failed to prove his case.
2. Petition is a pre-election matter and that it lacks merit. EPT lacks the jurisdiction to entertain the petition.
3. Petition is *Statute Barred*
4. Exclusion is not one of such grounds to declare an election invalid.
5. Petition is not in line with electoral offences as stipulated in 2022 electoral act as amended.
6. Pleadings of the petitioners are not supported by evidences and proved.
7. Petitioner’s petition is contradictory.
8. No registered original logo of the petitioner(NNPP) that was submitted to the 1st Respondent(INEC) was presented to the EPT in this matter.
9. There is nothing before this Court to show or prove that the 1st respondent(INEC) didn’t comply with the 2022 electoral act in respect to Oyo North Senatorial election held on Feb 25th, 2023.
10. Petition is not justifiable, invalidated and hereby dismissed.
The Chairman and the other panel member also (both) declared the petition incompetent and lack merit.
